The Dinner Elf Rewards Program (the “Program”) is brought to you by Dinner Elf, Inc. (“Dinner Elf” or “we”). Participation in the Program is subject to these terms and conditions and the general User Terms of Use and Privacy Policy which are incorporated herein (collectively, the “Program Terms”). Dinner Elf is a technology company which provides applications for users to arrange and schedule in-home cooking services. Dinner Elf is not a provider of in-home cooking services, as such all benefits and rewards offered under the program are offered on an “as available” basis, contingent upon third-parties’ availability to provide the services and other contingencies which may impact availability of some benefits at certain times and places. 

Eligibility

In order to participate as a Program Member (defined below) in the Program you must reside in the United States, and be 18 years of age or older with a Dinner Elf account in good standing. You may only have one Program account (“Program Account”) and may not share memberships. Memberships cannot be merged or transferred. By participating in this Program you are agreeing to these Program Terms. If you do not agree to these Program Terms, do not participate in the Program.

How to Earn Rewards

Rewards (“Rewards” or “Reward”) are earned as outlined in the rewards support article and may be modified by Dinner Elf at any time. The following Dinner Elf appointments are not eligible to earn Rewards in the Program: sample appointments and complimentary appointments. Rewards may be revoked if an order, for which Rewards were earned, is refunded. Rewards may be revoked where Dinner Elf believes in its discretion that Rewards were earned through or in connection with any fraud, abuse of the platform, or violation of Dinner Elf’s Terms of Use.

How To Redeem Rewards

Rewards have no cash value. Rewards can be redeemed on Dinner Elf appointments and Dinner Elf gifts on a 1:1 basis. For example, $50 in Rewards can be redeemed for $50 off an appointment. The redemption basis may be modified by Dinner Elf at any time. Redemption of Dinner Elf Rewards may be subject to additional terms and conditions, such as restrictions on use. 

Program Membership

All participants in the Program are “Program Members.” A Dinner Elf user signs up for the Program when they create a customer account at DinnerElf.com. 

How To View Rewards Balances

Program Members can view their current Rewards balances and Reward activity on their Dinner Elf Rewards page in their account. If you think your Rewards balance is incorrect, report your issue prior to your Reward Expiration (see below) by contacting Dinner Elf as noted in the Contact Us section below. If Dinner Elf agrees that a correction is needed, it may take up to two weeks.

Reward Expiration

Rewards are non-transferrable and expire (if not redeemed) after 12 months (“Reward Expiration”) without any Reward activity (earnings or redemptions). Dinner Elf will notify Program Members by email and/or text of pending expiration.  

Account Termination

Participation in the Program is a privilege granted to Program Members, and as such can be suspended, revoked, or terminated at any time by us for any reason. If your Program membership is terminated, all Rewards associated with your Program membership and any Program Benefits will be forfeited immediately upon termination. If your Program membership is terminated due to fraudulent activity or noncompliance with these Program Terms, in addition to forfeiting all Rewards and Program Benefits associated with your Program membership immediately, you cannot participate in or rejoin the Program.

Program Changes and Termination

We reserve the right to change or terminate the Program, or any part thereof, at any time without notice and without further obligations to Program Members, including, but not limited to modifications which: a) govern how Rewards are earned on and after the date of change; or b) change the value of Rewards. No Rewards will be earned or redeemed after the effective date of termination. Any and all changes and/or amendments to these Program Terms will become binding upon all members immediately.

Transfer of Rights

Dinner Elf’s rights and obligations under the Program may be assigned or transferred by Dinner Elf to any other related or unrelated entity at any time, and performances shall be the responsibility of that entity.

Interpretation of Program Terms

All interpretations of these Program Terms will be at Dinner Elf’s sole discretion and Dinner Elf’s decisions will be final.

Disclaimer

The Program and/or any of its features may be unavailable, inaccurate or interrupted from time to time for a variety of reasons. We are not responsible for any unavailability, interruptions or errors of the Program or its features. Dinner Elf is not responsible for unauthorized use of Rewards. If your Dinner Elf account is closed, you will lose all Rewards. Dinner Elf may from time to time request information from you to confirm your identity before it will allow use of your Rewards. Dinner Elf may delay your access to the Rewards until you comply with this information request. The Program and all the information accessible through it are provided for information purposes only on an “as is” and “as available” basis. We make no warranties, representations, or guarantees of any kind, express or implied, including but not limited to, accuracy, currency, or completeness, the operation of the Program, the information, materials, content, availability, and products. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.
